Terms and Conditions of Vehicle Sale

Please read these Terms and Conditions carefully before purchasing a vehicle from MTM Car Sales. These Terms and Conditions are in addition to your statutory rights under the Consumer Rights Act 2015 and other applicable consumer legislation.
1. Definitions
In these Terms and Conditions:
"Dealer", "We", "Us", or "Our" refers to MTM Car Sales.
"Customer", "You", or "Your" refers to the purchaser of the vehicle.
"Vehicle" refers to the motor vehicle being purchased.
"Warranty Provider" refers to Warranty First or any alternative warranty provider appointed by MTM Car Sales.
2. Vehicle Description
MTM Car Sales takes reasonable care to ensure all vehicle descriptions, specifications, mileage readings, photographs, advertisements, and information provided are accurate.
However:
Vehicle specifications may vary from manufacturer information.
Mileage readings cannot be guaranteed unless specifically stated.
Features and accessories should be confirmed by the customer before purchase.
Any statements made by staff shall not form part of the contract unless confirmed in writing.
Customers are encouraged to inspect the vehicle thoroughly and undertake a test drive before purchase.
3. Vehicle Condition
As the vehicles sold are used vehicles:
Fair wear and tear consistent with age, mileage, and previous use should be expected.
Minor cosmetic imperfections may be present.
Vehicles are sold in a condition appropriate for their age and mileage unless otherwise stated.
Customers acknowledge that used vehicles will not be in the same condition as a new vehicle.
4. Deposits
Any deposit paid secures the vehicle for the agreed period.
Deposits may be non-refundable if:
The customer decides not to proceed with the purchase.
Finance is declined due to inaccurate information supplied by the customer.
The customer fails to complete the transaction within the agreed timescale.
Where MTM Car Sales is unable to supply the vehicle, any deposit paid will be refunded in full.
5. Part Exchange Vehicles
Where a vehicle is accepted in part exchange:
The customer confirms they are the legal owner of the vehicle.
The vehicle is free from undisclosed finance, insurance claims, or ownership disputes.
Any valuation is based upon the condition and information supplied at the time of appraisal.
Should the condition of the part exchange vehicle differ materially from that declared, MTM Car Sales reserves the right to amend or withdraw the agreed valuation.
6. Payment
Full payment must be received and cleared before the vehicle is released.
Accepted payment methods may include:
Bank transfer
Debit card
Approved finance arrangements
Cash payments may be restricted in accordance with anti-money laundering regulations.
Ownership of the vehicle remains with MTM Car Sales until cleared funds have been received in full.
7. Warranty Cover
Vehicles Sold Above £3,000
Vehicles sold for £3,000 or more include a 3-Month Warranty First Warranty as standard unless otherwise stated in writing.
Warranty cover is subject to:
The terms and conditions of Warranty First.
Claim limits and exclusions set out by the warranty provider.
The customer following servicing and maintenance schedules recommended by the manufacturer.
Customers should refer to their Warranty First documentation for full details of cover.
Vehicles Sold Under £3,000
Vehicles sold for less than £3,000 include a 1-Month Engine and Gearbox Warranty Only unless otherwise agreed in writing.
This warranty covers:
Internal mechanical failure of the engine.
Internal mechanical failure of the gearbox.
The warranty does not cover:
Wear and tear.
Electrical faults.
Clutches.
Consumable items.
Suspension components.
Cosmetic defects.
Air conditioning systems.
Any item not specifically relating to the internal mechanical operation of the engine or gearbox.
8. Warranty Claims Procedure
In the event of a fault:
The customer must stop using the vehicle immediately if continued use could cause further damage.
The customer must contact MTM Car Sales as soon as reasonably possible.
No repair work should be authorised or commenced without prior approval from MTM Car Sales and/or the warranty provider.
Failure to obtain prior authorisation may result in rejection of any claim.
9. Inspection and Repairs
Before any warranty claim can be considered:
The vehicle must be returned to MTM Car Sales for inspection.
The customer is responsible for returning the vehicle to the dealership.
No third-party repair work should be undertaken without written authorisation.
MTM Car Sales reserves the right to:
Inspect the vehicle.
Repair the vehicle.
Appoint an independent repairer.
Refer the matter to the warranty provider.
Alternative arrangements may be agreed at the sole discretion of MTM Car Sales where returning the vehicle is impractical.
10. Customer Responsibilities
The customer agrees to:
Maintain the vehicle in accordance with manufacturer recommendations.
Regularly check oil, coolant, and fluid levels.
Ensure servicing is carried out when due.
Stop driving the vehicle if a warning light or fault develops that could cause damage.
Keep records of servicing and maintenance.
Failure to maintain the vehicle appropriately may invalidate warranty claims.
11. Consumer Rights
Nothing within these Terms and Conditions affects the customer's statutory rights under:
The Consumer Rights Act 2015.
The Consumer Contracts Regulations.
Any other applicable consumer protection legislation.
Customers may have additional rights regarding faulty goods which cannot be excluded by these Terms and Conditions.
12. Limitation of Liability
MTM Car Sales shall not be liable for:
Consequential losses.
Loss of earnings.
Loss of business use.
Alternative transport costs.
Accommodation costs.
Recovery charges.
Inconvenience arising from vehicle breakdown.
Unless expressly required by law.
13. Vehicle Collection
Upon collection, the customer confirms:
The vehicle has been inspected.
The vehicle has been accepted in satisfactory condition.
Any agreed defects or repairs have been documented.
Risk in the vehicle passes to the customer upon collection or delivery.
14. Data Protection
MTM Car Sales will process customer information in accordance with applicable data protection legislation including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Customer information may be shared with:
Finance providers.
Warranty providers.
Vehicle registration authorities.
Regulatory bodies where required.
15. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland and the United Kingdom.
Any disputes arising from the sale of a vehicle shall be subject to the jurisdiction of the Scottish Courts.
